Terms of use
Last updated: 2026-10-22
These terms apply to the use of Place Check (https://www.place-check.com) via the website, REST API and MCP server. Operator: place-check, Leopoldsdorf (private person, see the legal notice). This is a translation; the German version prevails.
1. Service
Place Check automatically creates a surroundings report for Austrian addresses from public data sources (e.g. noise, flood, climate, terrain, zoning, infrastructure) including a listing paragraph. The service is a private, non-commercial project and free of charge. There is no entitlement to any availability, feature set or to a report being created.
2. Account
Creating reports requires an account. Your details must be accurate; keep credentials and API keys secret. You are responsible for use through your account, your keys and your connected apps. You can delete the account at any time in the dashboard.
3. Credits
Credits are a free usage quota: a report uses 1 credit, refunded automatically if it fails entirely. New accounts get 1 free credit per mailbox; further credits may be given in promotions. Credits have no monetary value, are not transferable or redeemable for cash, and may lapse if the service ends or on abuse.
Paid options may be offered in the future; separate terms, which you must accept first, will apply to them.
4. Fair use, API and MCP
- Each API key allows at most 30 requests per minute (REST and MCP together); sign-in and search are limited per IP address.
- Not allowed: automated extraction (scraping) beyond the provided interfaces, building your own data sets from or reselling reports or data in bulk, circumventing limits (e.g. with several accounts), attacking the security of the service, and unlawful use.
- On violations, keys may be blocked, credits withdrawn or accounts deleted.
5. Accuracy of data
Reports are based on official and open third-party data, are generated automatically and may be incomplete, outdated or wrong; sources that do not answer are left out. Maps and zoning information are not legally binding. A report is not a valuation, not an expert opinion and not legal, tax or building advice, and does not replace information from the competent authority. Check important facts at the original source.
6. Use of reports and licences
You may use reports and listing paragraphs for your own purposes, e.g. in property listings. The data is subject to the licences of its sources (mostly CC BY 4.0, OpenStreetMap ODbL); keep the attribution when passing it on. Overview: data sources and licences. If you enter third parties' data (e.g. of clients), you are responsible for doing so lawfully.
7. Liability
The service is provided free of charge and without warranty. To the extent permitted by law, the operator's liability is excluded. This does not affect liability for intent and gross negligence, for personal injury, or under mandatory law (in particular towards consumers under the Austrian Consumer Protection Act, KSchG). There is no liability for the content or availability of third-party data sources.
8. Changes and discontinuation
The operator may change, limit or discontinue the service at any time; a discontinuation will be announced where possible. Changes to these terms are published on this page and, if material, notified to registered users; if you do not agree, you can delete your account. You can stop using the service at any time.
9. Governing law and venue
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of their country of residence; claims against consumers can only be brought at their domicile, habitual residence or place of employment (§ 14 KSchG).
